Nyírbátor város távhőtermelő és távhőszolgáltató rendszerének (fűtőmű, vezetékhálózat, hőközpontok, stb.) üzemeltetése, működtetése koncessziós társaság alapításával, 25 éves időtartamban - A beszerzésre kerülő Koncessziós Szerződés tárgya a távhő rendszer üzemeltetése, karbantartása, javítása, energiahordozók beszerzése, számlázás, pénzbeszedés, hátralékkezelés, ügyfélszolgálat működtetése, kötelező jelentések megküldése hivataloknak, adatszolgáltatás e-közmű rendszer felé. - A Koncessziós Szerződést Ajánlatkérő a nyertes ajánlattevővel köti, aki a Koncessziós Szerződésben „Koncesszor” - A Koncesszor kötelezettsége, hogy szerződéskötéstől 90 napon belül megalapítsa a „Koncessziós Társaságot” - A Koncessziós Társaság az alapításától számított 30 napon belül kérelemmel fordul a Magyar Energetikai és Közmű-szabályozási Hivatalhoz - Az engedély megszerzése napjával (általában az év első napja vagy évközbeni váltás esetén tárgyév október 1.,innen indul a 25 év futamidő) a Koncesszor átruházza a Koncessziós Szerződésből eredő jogait és kötelezettségeit a Koncessziós Társaságra. - A koncessziós díj alapját (MEKH tájékoztatása alapján), a közművagyonnak a jövőben elszámolt értékcsökkenése képezi. - A távhőrendszer közművagyon (önkormányzati és jelenlegi üzemeltető Nyírbátori Városfejlesztő és Működtető Kft. tulajdonában álló eszközök) körébe sorolt tárgyi eszközeinek vizsgálata alapján határozható meg a koncessziós díj várható mértéke az elkövetkező 25 évre.
