This is NOT a solicitation for proposals, proposal abstracts, or quotations. The Division of Safety manages the emergency response protocols for potential high-risk pathogen exposures of personnel working in high and/or maximum containment laboratories at the NIH Rocky Mountain Laboratories in Hamilton, Montana. These emergency response protocols are required to have patient isolation services at a licensed medical facility by a federal lawsuit settlement agreement and to remain in compliance with the incident response requirements of the federal select agent regulations. Having these mission critical safety services in place allows RML to continue emerging disease research in support of the mission of NIH and HHS. In 2006, the NIH awarded a contract to Providence St. Patrick Hospital in Missoula, Montana to construct a Care and Isolation Unit to provide patient isolation services for personal potentially exposed to high-risk pathogens from the RML high and/or maximum containment labs. This was required by a federal lawsuit settlement agreement to provide patient isolation services at a licensed medical facility within 75 miles of RML [Coalition for a Safe Lab v. National Institutes of Health, CV-04-158-M-DWM (D. Mont. 2004)]. These services are also required to remain in compliance with the incident response requirements of the federal select agent regulations [42 CFR Part 73, 9 CFR Part 121, and 7 CFR Part 331]. The NIH has continued to renew this contract to continue providing these critical safety services for the past 20 years to remain in compliance with both the lawsuit settlement agreement and the federal select agent regulations. Providence St. Patrick Hospital is the only medical facility within the required 75 mile radius that can provide these specialized serv

This action is for the procurement of a quantity of three (3) Mobile Power Conditioning Unit/Power Supply Set (PN: Z345P-220-1, NSN: 6130-01-657-1701) for the F/A-18 Kuwait program. The Original Equipment Manufacturer (OEM) of these items is Zitec, Inc., CAGE: 1R9V9. Under authority 10 U.S.C.2304(c)(1) and implemented in FAR 6.302-5(a)(2)(i), to try to develop this “asset" would incur costs that are not expected to be recouped through competition. Any attempt to procure a different part number would require the Government to fund a Preliminary Design Review (PDR) Critical Design Review (CDR) First Article Test (FAT) and Test & Evaluation (T&E) effort for a new vendor. The Government would have to fund personnel to be on the Source Selection Team to review proposals. Any change in form, fit or function would require changes to the existing Integrated Logistics Support (ILS) (technical publications, spares inventory, calibration) which would incur additional costs for update in the amount of $200,000 to $400,000. The process required to obtain an alternate asset is cost-prohibitive and would force the FMS Partner to utilize an asset that is not supportable or compatible with their current configuration and required need. This requirement will be processed under the authority 10 U.S.C.2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. Market Research was performed by the Lakehurst Technical team. The Original Equipment Manufacturer is Zitec, Inc., CAGE: 1R9V9. All technical data rights and information related to the Mobile Power Conditioning Units/Power Supply Units belongs to Zitec, Inc. No additional vendors were identified. The Government does not have in its possession sufficient, accurate, or legible data to purchase this part from anyone other than the current source nor have the means of acquiring said data. This project executes Phase I of a multi phase recapitalization program to prepare a 500 plus acre site and establish the critical civil utility and airfield infrastructure. Due to complex topography and concurrent MILCON construction schedules the work must be highly sequenced to ensure uninterrupted operational capabilities and facilitate staggered facility occupancy dates. Utilizing an Other Transaction OT Agreement under the authority of 10 USC 2808a Facility Construction or Repair Transactions Other Than Contracts and Grants. This authority is distinct from the Department of Defense prototype OT authorities commonly associated with 10 USC 4021 and 4022. This authority is intended for military construction projects that involve testing and experimentation associated with new and emergent construction technologies to achieve potential benefits such as enhanced mission resilience improved installation support or cost and schedule reduction. The anticipated delivery method is Construction Manager at Risk CMAR. Phase 1 Pre Construction Services The OT Awardee shall assist the Government collaboratively in achieving its goals with respect to the projects scope constructability budget quality schedule and in coordination with the Designer of Record DOR. Phase 2 Construction Upon reaching an agreed upon level of design such as 65 percent to 95 percent the Awardee will propose a Guaranteed Maximum Price GMP. If the GMP is accepted the Government will exercise construction execution.
