The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor recieves notice of such availability, to be confirmed in writing by the Contracting Officer. Warren AFB, WY intends to award a Single Source, Single-Award Firm Fixed Price contract to Carter's Avionics & Aviation Maintenance, LLC for MH-139A battery maintenance. The anticipated award date is on or around 30 October 2026. The statutory authority which permits other than full and open competition for this acquisition is 41 United States Code (USC) 1901, as implemented by RFO 12.201-1. This authority is supported by an approved Single Source Justification. It is the Government's intent to proceed with this sole-source action. The applicable NAICS code is 488190.
